Thane International's Advertising Claims Come Under Scrutiny
in NAD Regulatory
Process
New York, NY - January 27, 2000 - The National Advertising
Division (NAD) of the Council of Better Business Bureaus, Inc.
(CBBB), the advertising industry's national forum for voluntary
self regulation, announced its determination that advertising
claims for Thane International's (Thane) Alexandria Body Sugaring
System and D'Lay CrËme Hair Inhibitor required
modification.
Thane's advertising was challenged by S3 International Inc./Young
Forever, which maintained that the advertiser's claims in
Web and infomercial advertising, as well as the product's packaging,
were "false, misleading and unsubstantiated."
NAD recommended that the advertiser (1) modify its product
performance claims to avoid overstating the inhibition of hair
re-growth that consumers can expect with the use of the product;
(2) discontinue the use of the hair inhibition claims for the
D'Lay Hair Inhibition CrËme; and, (3) modify or discontinue
the use of comparative claims that tend to overstate the
performance differences between various methods of hair removal.
Thane stated its appreciation of NAD's decision and agreed
to accept NAD's recommendations for its advertising. NAD
appreciates the willingness of both parties to participate
in this voluntary forum and acknowledges their efforts to foster
truth in
advertising.
NAD's inquiry was conducted under NAD/CARU/NARB Procedures
for the Voluntary Self-Regulation of National
Advertising. Details of the initial inquiry, NAD's decision
and the advertiser's response will be included in the next NAD
Case
Report.
